At the request of the Director General of the Vietnam Population Authority;

The Minister of Health promulgates the Circular on the list of diseases for which fetal sex may be disclosed for diagnostic and treatment.

Article 1. The List of diseases for which fetal sex may be disclosed for diagnostic and treatment

This List of diseases for which fetal sex may be disclosed for diagnostic and treatment as prescribed in clause 3, Article 6 of the Law on Population is attached to this Circular.

Article 2. Definitions

1. Determination of fetal sex for diagnostic and treatment means the use of professional medical techniques to identify the fetal sex chromosome pair, sex-determining genes or sex phenotype of the fetus for diagnosing genetic disorders that exhibit different manifestations in males and females.

2. Sex-related diseases for diagnostic and treatment are genetic or congenital diseases, defects or syndromes associated with sex chromosomes or genes that affect the process of sex determination and sex development in which determining the sex of the fetus is significant for disease diagnosis, prognosis, treatment or prevention.

3. Sex-linked genetic disorders are a group of diseases caused by genetic variants located on sex chromosomes.

4. Disorders of sex development (DSDs) are congenital conditions that result in atypical sex development due to abnormalities of the sex chromosomes, gonads, or genital organs.

Article 3. Principles for establishing the List of diseases for which fetal sex may be disclosed for diagnostic and treatment

Diseases included in the List of diseases for which fetal sex may be disclosed for diagnostic and treatment shall satisfy the following principles:

1. There are mechanisms related to sex that have clinical significance for diagnosis, prognosis or decision-making in prenatal or neonatal management including sex-related diseases, sex-linked genetic disorders, abnormalities in the number or structure of sex chromosomes, and disorders of sex development.

2. There are scientific names in Vietnamese that are consistent with ICD-10 codes.

Article 4. Effect

This Circular comes into force from July 01, 2026.

Article 5. Implementation

1. The Vietnam Population Authority shall:

a) Take charge and cooperate with relevant units in deploying, providing guidelines and inspecting the implementation of this Circular;

b) Every two years, or when there are professional, technical or legal requirements, the Vietnam Population Authority shall take charge in reviewing and proposing amendments to the List attached to this Circular;

c) Publish the List of diseases for which fetal sex may be disclosed for diagnostic and treatment on the website of the Vietnam Population Authority and the electronic information portal of the Ministry of Health.

2. Within the scope of assigned functions and tasks, Departments and the Ministry Office under the Ministry of Health shall proactively provide guidelines for relevant authorities and units in implementing this Circular.

3. Specialized health authorities under province-level People’s Committees shall direct, provide guidelines and inspect medical examination and treatment establishments under their management in complying with regulations on determination of fetal sex for diagnostic and treatment purposes; and shall handle violations within their authority or propose them to competent authorities for handling in accordance with the laws.

4. Medical examination and treatment establishments may:

a) May inform and disclose the fetal sex for diagnostic and treatment in accordance with the List prescribed in this Circular;

b) Provide counseling before and after performing technical services including information on the scope, significance and limitations of the technical service, as well as the possibility that certain diseases may not be detected during the testing process;

c) Heads of medical examination and treatment establishments are responsible in accordance with the laws if the fetal sex is disclosed for purposes other than diagnosis and treatment, or beyond the scope prescribed in this Circular;

In cases where sex-related genetic diseases, defects or syndromes cannot be detected due to limitations of screening techniques or methods, absence of risk factors, or newly arising variants leading to inability to identify the disease, the failure to provide fetal sex information for diagnostic and treatment purposes shall not be considered a violation of professional regulations.

Authorities, organizations and individuals shall report any issues during the implementation to the Ministry of Health (Vietnam Population Authority) for guidelines and resolution./.
