ON AMENDMENTS TO SOME ARTICLES OF CIRCULAR NO. 51/2022/TT-BCA DATED NOVEMBER 09, 2022 OF THE MINISTER OF PUBLIC SECURITY ELABORATING PROCEDURES FOR INSPECTION OF THE COMPLIANCE WITH THE LAWS ON ENVIRONMENT, RESOURCES AND FOOD SAFETY; INSPECTION OF MEANS, SUBJECTS AND LOCATIONS RELATED TO CRIMES AND ADMINISTRATIVE VIOLATIONS REGARDING ENVIRONMENT, RESOURCES AND FOOD SAFETY
Pursuant to the Law on Penalties for Administrative Violations No. 15/2012/QH13 (amended by the Law No. 67/2020/QH14 and Law No. 88/2025/QH15);
Pursuant to the Law on Environmental Protection No. 72/2020/QH14;
Pursuant to the Ordinance on Environmental Police No. 10/2014/UBTVQH13 (amended by the Ordinance No. 09/2025/UBTVQH15);
Pursuant to Decree No. 105/2015/ND-CP dated October 20, 2015 of the Government elaborating some articles of the Ordinance on Environmental Police (amended by Decree No. 157/2024/ND-CP dated December 16, 2024 and Decree No. 184/2025/ND-CP dated July 01, 2025);
Pursuant to Decree No. 08/2022/ND-CP dated January 10, 2022 of the Government elaborating some articles of the Law on Environmental Protection (amended by Decree No. 05/2025/ND-CP dated January 06, 2025);
Pursuant to Decree No. 02/2025/ND-CP dated February 18, 2025 of the Government on functions, tasks, powers and organizational structures of the Ministry of Public Security (amended by Decree No. 11/2025/ND-CP dated July 01, 2025);
At the request of the head of the Police Department of Environmental Crime Prevention;
The Minister of Public Security promulgates the Circular on amendments to some articles of Circular No. 51/2022/TT-BCA dated November 09, 2022 of the Minister of Public Security elaborating procedures for inspection of the compliance with the laws on environment, resources and food safety; inspection of means, subjects and locations related to crimes and administrative violations regarding environment, resources and food safety.
Article 1. Amendments to clause 4, Article 4
“4. During the implementation of the inspection decision, if the position or duties of the person who issued the inspection decision as prescribed in clause 2, Article 7 and clause 2, Article 8 of Decree No. 105/2015/ND-CP dated October 20, 2015 of the Government elaborating some articles of the Ordinance on Environmental Police (amended by Decree No. 157/2024/ND-CP dated December 16, 2024 and Decree No. 184/2025/ND-CP dated July 01, 2025) (hereinafter referred to as “Decree No. 105/2015/ND-CP”) changes resulting in loss of authority as prescribed by laws, the person replacing that position or duties (according to the appointment decision, transfer decision, assignment document from competent authorities, or handover minutes in cases where handover is required) is responsible for directing the implementation of the inspection decision. If the person issued the inspection decision as prescribed in Article 10 of Decree No. 105/2015/ND-CP, that person’s superior shall replace and direct the implementation of the inspection decision (hereinafter referred to as “replacement person”).”.
Article 2. Amendments to Article 5
“Article 5. Responsibilities of relevant authorities, organizations and individuals
Relevant authorities, organizations and individuals related to the application of regulations on inspection as prescribed in Articles 7 and 8 of Decree No. 105/2015/ND-CP and Article 163 of Decree No. 08/2022/ND-CP dated January 10, 2022 elaborating some articles of the Law on Environmental Protection (amended by Decree No. 05/2025/ND-CP dated January 06, 2025) (hereinafter referred to as “Decree No. 08/2022/ND-CP”) shall strictly comply with the inspection decisions issued by competent authorities in accordance with the laws; have the right to petition, complain and denounce as prescribed by laws against decisions or actions of competent authorities or persons during inspection of the compliance with the laws on environment, resources and food safety, inspection of means, subjects and locations related to crimes and administrative violations regarding environment, resources and food safety, if there is evidence that such decisions or actions are illegal”.
Article 3. Amendments to point b, clause 1, Article 7
“b) Regarding inspection subjects: Specify necessary information and characteristics to identify the inspection subject (categorized by type of object such as mean, subject, or location). In cases where the inspected location is a residence, the President of commune-level People’s Committee where the location is located shall review, decide and carry out in accordance with laws on penalties for administrative violations.”.
Article 4. Replacement of templates attached to Circular No. 51/2022/TT-BCA dated November 09, 2022 of the Minister of Public Security elaborating procedures for inspection of the compliance with the laws on environment, resources and food safety; inspection of means, subjects and locations related to crimes and administrative violations regarding environment, resources and food safety
1. The template of Authorization form (Form No. 01) is replaced by the template of Authorization form attached to this Circular.
2. The template of Decision on inspection of compliance with laws on resources and food safety (Form No. 02) is replaced by the template of Decision on inspection of compliance with laws on resources and food safety attached to this Circular.
3. The template of Decision on inspection of vehicles related to crimes or administrative violations regarding environment, resources and food safety (Form No. 03) is replaced by the template of Decision on inspection of vehicles related to crimes or administrative violations regarding environment, resources and food safety attached to this Circular.
4. The template of Decision on inspection of subjects related to crimes or administrative violations regarding environment, resources and food safety (Form No. 04) is replaced by the template of Decision on inspection of subjects related to crimes or administrative violations regarding environment, resources and food safety attached to this Circular.
5. The template of Decision on inspection of locations related to crimes or administrative violations regarding environment, resources and food safety (Form No. 05) is replaced by the template of Decision on inspection of locations related to crimes or administrative violations regarding environment, resources and food safety attached to this Circular.
6. The template of Minutes of announcement of the inspection decision (Form No. 06) is replaced by the template of Minutes of announcement of the inspection decision attached to this Circular.
7. The template of Minutes of inspection of compliance with laws on environment, resources and food safety (Form No. 07) is replaced by the template of Minutes of inspection of compliance with laws on environment, resources and food safety attached to this Circular.
8. The template of Minutes of inspection of vehicles related to crimes or administrative violations regarding environment, resources, and food safety (Form No. 08) is replaced by the template of Minutes of inspection of vehicles related to crimes or administrative violations regarding environment, resources, and food safety attached to this Circular.
9. The template of Minutes of inspection of subjects related to crimes or administrative violations regarding environment, resources and food safety (Form No. 09) is replaced by the template of Minutes of inspection of subjects related to crimes or administrative violations regarding environment, resources and food safety attached to this Circular.
10. The template of Minutes of inspection of locations related to crimes or administrative violations regarding environment, resources and food safety (Form No. 10) is replaced by the template of Minutes of inspection of locations related to crimes or administrative violations regarding environment, resources and food safety attached to this Circular.
11. The template of Written request for inspection extension (Form No. 11) is replaced by the template of Written request for inspection extension attached to this Circular.
12. The template of Decision on inspection extension (Form No. 12) is replaced by the template of Decision on inspection extension attached to this Circular.
13. The template of Inspection conclusion form (Form No. 13) is replaced by the template of Inspection conclusion form attached to this Circular.
14. The template of Record on incidents/cases (Form No. 14) is replaced by the template of Record on incidents/cases attached to this Circular.
Article 5. Implementation clause
1. This Circular comes into force from March 01, 2026.
2. The Police Department of Environmental Crime Prevention are responsible for supervising, inspecting and urging the implementation of this Circular.
3. The heads of units affiliated to Ministry of Public Security, Directors of Police Departments of provinces and cities are responsible for implementing this Circular.
If there are any difficulties or obstacles during the implementation of this Circular, police authorities shall report to the Ministry of Public Security (through Police Department of Environmental Crime Prevention) for timely instructions./.
