Circular No. 50/2026/TT-BCT on amendments to Circular No. 37/2025/TT-BCT providing guidance on functions, tasks, powers of specialized industry and trade agencies affiliated to People’s Committees of provinces and central-affiliated cities and People’s Committees of communes, wards and special zones of provinces and central-affiliated cities

AMENDMENTS TO CIRCULAR NO. 37/2025/TT-BCT DATED JUNE 14, 2025 OF MINISTER OF INDUSTRY AND TRADE OF VIET NAM PROVIDING GUIDANCE ON FUNCTIONS, TASKS, POWERS OF SPECIALIZED INDUSTRY AND TRADE AGENCIES AFFILIATED TO PEOPLE’S COMMITTEES OF PROVINCES AND CENTRAL-AFFILIATED CITIES AND PEOPLE’S COMMITTEES OF COMMUNES, WARDS AND SPECIAL ZONES OF PROVINCES AND CENTRAL-AFFILIATED CITIES

Pursuant to the Government’s Decree No. 351/2026/ND-CP defining functions, tasks, powers and organizational structure of the Ministry of Industry and Trade of Viet Nam;

Pursuant to the Government’s Decree No. 150/2025/ND-CP prescribing organization of specialized agencies affiliated to People’s Committees of provinces and central-affiliated cities and People’s Committees of communes, wards and special zones of provinces and central-affiliated cities, as amended by the Decree No. 370/2025/ND-CP;

Pursuant to the Government’s Resolution No. 66.25/2026/NQ-CP on handling of difficulties relating to division of the functions, tasks and powers in performing state management of industrial parks, geology and mineral sectors;

At the request of the Head of the Organization and Personnel Department;

The Minister of Industry and Trade of Viet Nam hereby promulgates a Circular providing amendments to Circular No. 37/2025/TT-BCT dated June 14, 2025 of Minister of Industry and Trade of Viet Nam providing guidance on functions, tasks, powers of specialized industry and trade agencies affiliated to People’s Committees of provinces and central-affiliated cities and People’s Committees of communes, wards and special zones of provinces and central-affiliated cities.

Article 1. Amendments to Circular No. 37/2025/TT-BCT

1. Clause 1 Article 3 is amended as follows:

”1. Provincial-level Departments of Industry and Trade are specialized agencies affiliated to provincial-level People’s Committees; take charge of advising and assisting provincial-level People’s Committees in the exercise of state management over industry and trade, covering the following fields and sectors: electricity; coal; geology; minerals; petroleum; new energy; renewable energy; economical and efficient use of energy; chemicals; industrial explosives and explosive materials; mechanical engineering; metallurgy; consumer industries; food industries; supporting industries; environmental industries; high-tech industries (excluding digital technology industries); industry promotion; industrial clusters; cottage industries and handicrafts; domestic trade; import and export; border trade; logistics services; development of overseas markets; market surveillance and management; trade promotion; e-commerce; commercial services; international economic integration; competition; protection of consumer rights and interests; trade remedies; and public services in the sectors and fields falling within the scope of the Ministry’s state management.”.

2. Clause 1 Article 4 is amended as follows:

“1. Perform tasks and powers as prescribed in Article 4 of Decree No. 150/2025/ND-CP prescribing organization of specialized agencies affiliated to People’s Committees of provinces and central-affiliated cities and People’s Committees of communes, wards and special zones of provinces and central-affiliated cities, as amended by the Decree No. 370/2025/ND-CP.”.

3. Point c clause 2 Article 4 is amended as follows:

“c) Heavy industry and light industry”.

4. Point y Clause 2 Article 4 is amended as follows:

“y) Geology and minerals.”.

5. Clause 1 Article 5 is amended as follows:

“1. Economic Divisions or Economic, Infrastructure and Urban Divisions are specialized agencies affiliated to communal-level People’s Committees, and take charge of advising and assisting communal-level People’s Committees in the exercise of state management over industry and trade in their localities in accordance with law or as assigned, delegated, or otherwise authorized, or as otherwise provided for under the division of powers and responsibilities by a competent authority (with respect to other sectors and fields falling within the scope of their responsibility, Economic Divisions or Economic, Infrastructure and Urban Divisions shall comply with the guidance given by corresponding supervisory ministries).”.

6. Clause 20 is added following clause 19 Article 6 as follows:

“20. Advise and assist communal-level People’s Committees in the exercise of state management over geology and minerals in accordance with applicable regulations of law.”.

Article 2. Effect

This Circular comes into force from September 15, 2026.

Article 3. Transition

Specialized agencies affiliated to provincial-level People’s Committees shall continue to advise and assist the provincial-level People’s Committees in performing their tasks and exercising their powers of state management over food safety in accordance with regulations of the law on food safety until otherwise provided by a competent authority.

Article 4. Responsibility for implementation

1. Provincial-level People’s Committees and their Chairpersons; communal-level People’s Committees and their Chairpersons shall direct and organize the implementation of this Circular.

2. In the course of implementing this Circular, any difficulties arising or any amendments deemed necessary should be reported to the Ministry of Industry and Trade of Viet Nam for consideration./.
