Decree No. 136/2026/ND-CP on amendment to Decree No. 100/2024/ND-CP elaborating the Law on Housing pertaining to social housing development and management (amended by Decree No. 261/2025/ND-CP and Decree No. 54/2026/ND-CP)

DECREE

AMENDMENT TO DECREE NO. 100/2024/ND-CP DATED JULY 26, 2024 OF THE GOVERNMENT ELABORATING THE LAW ON HOUSING PERTAINING TO SOCIAL HOUSING DEVELOPMENT AND MANAGEMENT (AMENDED BY DECREE NO. 261/2025/ND-CP AND DECREE NO. 54/2026/ND-CP)

Pursuant to the Law on Government Organization No. 63/2025/QH15;

Pursuant to the Law on Housing No. 27/2023/QH15; the Law on amendment to the Land Law No. 31/2024/QH15, the Law on Housing No. 27/2023/QH15, the Law on Real Estate Trading No. 29/2023/QH15, and the Law on Credit Institutions No. 32/2024/QH15;

At request of the Minister of Construction;

The Government promulgates Decree on amendment to Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government elaborating the Law on Housing pertaining to social housing development and management (amended by Decree No. 261/2025/ND-CP and Decree No. 54/2026/ND-CP).

Article 1. Amendment to Decree No. 100/2024/ND-CP dated July 26, 2024 of the Government on amendment to the Law on Housing pertaining to social housing development and management amended by Decree No. 261/2025/ND-CP and Decree No. 54/2026/ND-CP of the Government (hereinafter referred to as “amended Decree No. 100/2024/ND-CP”)

1. Amend Clause 1 Article 30:

“Article 30. Income eligibility

1. Entities under Clauses 5, 6, and 8 Article 76 of Housing Law must meet income requirements below:

a) Where an applicant is not married or certified to be single, his/her monthly net income must not exceed VND 25 million based on pay slip verified by his/her employer, agency, enterprise.

Where an applicant is not married or certified to be single and is raising a minor, his/her monthly net income must not exceed VND 35 million based on pay slip verified by his/her employer, agency, enterprise.

b) Where an applicant is married as per the law, monthly net income of the applicant and his/her spouse must not exceed VND 50 million according to pay slip verified by their employers, workplaces, enterprises.

c) Determination of income requirements under Point a and Point b of this Clause shall be conducted within 12 consecutive months following the date on which competent authorities verify.

d) Depending on local conditions and income level of administrative divisions, housing incentive policies for cadres, public servants, public employees, and number of legal dependents as per the law, provincial People’s Committees may decide on income limits under Point a and Point b of this Clause without exceeding local income per capita relative to nationwide income per capita; decide on incentive policies for access to social housing for beneficiaries of social housing support policies with 3 dependents or more living in the same household.”

2. Amend Clause 1 and Clause 2 Article 67:

“1. Where applicant is not married, the applicant shall receive monthly net income not greater than total income of an officer holding general officer rank (consisting of minimum wages and allowances as per the law, including region-based allowances in rural areas, remote areas, borders, island with disadvantaged conditions) verified by his/her employer, workplace, enterprise.

2. Where the applicant is married:

a) Where the applicant and his/her spouse fall under the case described in Clause 7 Article 76 of the Law on Housing, their total net monthly income shall not exceed twice the total income of officers holding general officer rank (consisting of minimum wages and allowances as per the law, including region-based allowances in rural areas, remote areas, borders, island with disadvantaged conditions) verified by their employers, workplace, enterprises;

b) Where the applicant and his/her spouse do not fall under the case described in Clause 7 Article 76 of the Law on Housing, their total net monthly income shall not exceed the total income of officers holding general officer rank (consisting of minimum wages and allowances as per the law, including region-based allowances in rural areas, remote areas, borders, island with disadvantaged conditions) plus salaries under Point a Clause 1 Article 30 hereof verified by their employers, workplace, enterprises.

Where spouse of the applicant falls under Clause 5 Article 76 of the Housing Law and is not working under employment contract, verification of income requirements shall conform to Clause 2 Article 30 hereof.”

3. Amend Form No. 1 under Appendix II (application for purchase, lease-purchase, and rent of social housing).

Article 2. Transition clauses

Documents proving fulfillment of income requirements in order to receive social housing support policies that have been verified by competent authorities before the effective date hereof shall remain usable and valid for 12 months from the date on which the documents are verified.

Article 3. Entry into force

This Decree comes into force from April 7, 2026.

Article 4. Responsibilities for organizing implementation

1. The Minister of Construction has the responsibility to provide guidelines and arrange implementation of this Decree.

2. Ministers, figureheads of ministerial agencies, Chairpersons of People’s Committees of provinces and central-affiliated cities, and relevant agencies are responsible for the implementation of this Decree.
