Resolution No. 203/2025/QH15 on amendments to certain Articles of the Constitution of the Socialist Republic of Vietnam

RESOLUTION

AMENDMENTS TO CERTAIN ARTICLES OF THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM

THE NATIONAL ASSEMBLY OF VIETNAM

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Resolution No. 194/2025/QH15 dated May 05, 2025 of the National Assembly providing amendments to certain Articles of the Constitution 2013;

HEREIN RESOLVES:

Article 1

Certain Articles of the Constitution of the Socialist Republic of Vietnam are amended as follows:

1. Article 9 is amended as follows:

“Article 9

1. The Vietnamese Fatherland Front is a political alliance acting as a voluntary union of political organizations, socio-political organizations, social organizations and prominent individuals representing their classes, social strata, ethnicity or religions and overseas Vietnamese people.

The Vietnamese Fatherland Front forms part of the political system of the Socialist Republic of Vietnam, and operates under the leadership of the Communist Party of Vietnam (CPV); is a political base of the people’s power; gathers and promotes the strength of the great national unity; represents the will, aspirations, and mastery of the people; represents and protect rights, and lawful and legitimate interests of the people; practices democracy and strengthens social consensus; enhances social supervision and criticism; receives and submits the people’s opinions and petitions to regulatory authorities; participates in the building of the Communist Party and the State, and in people’s external affairs, thus contributing to the national construction and defense.

2. The Trade Union of Vietnam, Vietnam Farmer’s Union, Communist Youth Union of Ho Chi Minh City, Vietnam Women’s Union, and Vietnam Veterans Association are socio-political organizations affiliated to the Vietnamese Fatherland Front, are established on a voluntary basis to represent and protect rights, and lawful and legitimate interests of their members; are organized and operate in a consistent manner under the direction of the Vietnamese Fatherland Front; and shall, together with other member organizations of the Vietnamese Fatherland Front, hold democratic consultations, and enter into cooperation, coordination and unanimity in action with the leading role of the Vietnamese Fatherland Front.

3. The Vietnamese Fatherland Front, its member organizations, and other social organizations operate within the framework of the Constitution and law. The State shall consider facilitating activities of the Vietnamese Fatherland Front, its member organizations, and other social organizations.”;

2. Article 10 is amended as follows:

“Article 10

The Trade Union of Vietnam is a socio-political organization of the working class and the labour forces; represents, cares for, and protects rights, and lawful and legitimate interests of trade unionists and workers; is the sole national-level representative of workers in labour relations and international relations regarding trade union affairs; participates in state management and socioeconomic management; engages in inspection, oversight and supervision of regulatory authorities, organizations, units and enterprises in respect of the matters concerning rights and obligations of workers; organizes propagation activities, and encourages workers to attend training courses to improve their professional qualifications and skills, comply with law, and engage in the building and defense of the Fatherland.”;

3. Clause 1 Article 84 is amended as follows:

“1. The President of Vietnam, the Standing Committee of the National Assembly, the Ethnic Minorities Council, the National Assembly Committees, the Government of Vietnam, the Supreme People’s Court, the Supreme People’s Procuracy, the State Audit Office of Vietnam, the Central Committee of Viet Nam Fatherland Front, and central-level agencies of socio-political organizations shall have the right to submit bills and draft ordinances to the National Assembly and the Standing Committee of the National Assembly respectively.”;

4. Article 110 is amended as follows:

“Article 110

1. Administrative divisions of the Socialist Republic of Vietnam are organized into two levels. First-level administrative divisions are provinces and central-affiliated cities, each of which is subdivided into multiple second-level administrative divisions as prescribed by law.

2. Special administrative – economic divisions are established by the National Assembly.

3. Establishment, dissolution, merger, splitting and modification of geographical borders of administrative divisions require opinions of the local people and follow the procedures adopted by the National Assembly.”;

5. Article 111 is amended as follows:

“Article 111

1. Local governments are organized at administrative divisions of the Socialist Republic of Vietnam.

2. Local governments include People’s Councils and People’s Committees that are organized at administrative divisions in conformity with the characteristics of specific rural areas, urban areas and islands as prescribed by the National Assembly.

3. The National Assembly shall stipulate the local governments at a special administrative – economic division when establishing this special administrative – economic division.”.

Article 2

1. This Resolution comes into force from the day on which it is ratified.

The President of Vietnam shall follow procedures for announcement of this Resolution.

2. Operation of district-level administrative divisions nationwide shall be terminated from July 01, 2025.

3. When strengthening the organizational structures of agencies upon arrangement of administrative divisions and termination of operation of district-level administrative divisions in 2025, the following titles, including Chairpersons and Deputy Chairpersons of People’s Councils, Heads of Committees affiliated to People’s Councils, Chairpersons, Deputy Chairpersons and Members of People’s Committees at administrative divisions established upon arrangement, and Heads and Deputy Heads of National Assembly Delegations in provinces and central-affiliated cities established upon arrangement, shall not be elected. According to the notices given by CPV executive committees in charge of managing officials, the Standing Committee of National Assembly shall appoint Chairpersons and Deputy Chairpersons of People’s Councils, Heads of Committees affiliated to People’s Councils, Heads and Deputy Heads of National Assembly Delegations in provinces and central-affiliated cities established upon arrangement; the Prime Minister of Vietnam shall appoint Chairpersons and Deputy Chairpersons of People’s Committees of provinces and central-affiliated cities established upon arrangement; the Standing Committees of People’s Councils shall appoint Members of the same-level People’s Committees, and Chairpersons and Deputy Chairpersons of People’s Councils, Heads of Committees affiliated to People’s Councils, Chairpersons and Deputy Chairpersons of People’s Committees of the second-level administrative divisions established upon arrangement; the Standing Committees of People’s Councils of the second-level administrative divisions established upon arrangement shall appoint Members of the same-level People’s Committees. In special circumstances, officials who are not delegates of People’s Councils may be appointed as Chairpersons, Deputy Chairpersons of, and Heads of Committees affiliated to People’s Councils of administrative divisions established upon arrangement, or to act as delegates of People’s Councils to establish provisional People’s Councils of the Wards in which the model of an urban government without People’s Council is applied.

This Resolution is ratified by the 15^th National Assembly of the Socialist Republic of Vietnam during its 9^th session held on June 16, 2025.
