AMENDING SOME ARTICLES OF THE LAW ON VIETNAM FATHERLAND FRONT, law on trade union, youth law, law on IMPLEMENTATION OF GRASSROOTS-LEVEL DEMOCRACY

Pursuant to the Constitution of the Socialist Republic of Vietnam, which is amended by Resolution No. 203/2025/QH15;

The National Assembly hereby issues the law amending some articles of the Law on Vietnam Fatherland Front, Law on Trade Union, Youth Law, and Law on Implementation of Grassroots-level Democracy

Article 1. Amendments to the Law on Vietnam Fatherland Front

1. Amendment to Article 1:

“Article 1. Vietnam Fatherland Front

Inheriting the historical role of the Vietnam National United Front, which was founded and led by the Communist Party of Vietnam and President Ho Chi Minh, the Vietnam Fatherland Front is a political alliance organization and a voluntary coalition of political organizations, socio-political organizations, social organizations, and prominent individuals from various social classes, ethnicities, religions, and Vietnamese people residing abroad.

The Vietnam Fatherland Front is a component of the political system of the Socialist Republic of Vietnam; serves as the political foundation of the people’s government; unites and promotes the great national solidarity; expresses the will and aspirations and promotes the people’s mastery rights; represents and protects the lawful and legitimate rights and interests of the people; implements democracy and strengthens social consensus; supervises and conducts social criticism; submits the opinions and petitions of the people to state agencies; participates in building the CPV and the State, and in people’s foreign affairs activities contributing to the construction and defense of the Fatherland.

2. Amendment to clause 3 of Article 4:

“3. Socio-political organizations, together with other member organizations of the Front, engage in democratic consultation, cooperate, and unify actions under the leadership of the Vietnam Fatherland Front, while promoting the initiative and creativity of each member organization.

When cooperating and unifying activities, member organizations of the Vietnam Fatherland Front must comply with the Constitution, laws, the Charter of the Vietnam Fatherland Front, and the charters of each organization.

3. Amendment to Article 5:

“Article 5. Members of Vietnam Fatherland Front

1. Members of the Vietnam Fatherland Front are organizations or individuals as prescribed in Article 1 hereof and the Charter of the Vietnam Fatherland Front.

2. Socio-political organizations ((including the Vietnam Trade Union, the Vietnam Farmers’ Union, the Ho Chi Minh Communist Youth Union, the Vietnam Women’s Union, and the Vietnam Veterans Association) and mass organizations assigned by the CPV and the State to be affiliated to the Vietnam Fatherland Front are organized and operate uniformly within the Vietnam Fatherland Front.

3. The rights and responsibilities of member organizations of the Vietnam Fatherland Front are prescribed by this Law, relevant laws, the Charter of the Vietnam Fatherland Front, and the charters of each organization.

4. The procedures for joining, cancellation of membership, rights, and responsibilities of members of the Vietnam Fatherland Front shall be prescribed by the Charter of the Vietnam Fatherland Front.”.

4. Amendment to point b of clause 2 of Article 6:

b) In each administrative division: There is a Committee of Vietnamese Fatherland Front of province/centrally affiliated city and (hereinafter referred to as provincial Committee), Committee of Vietnamese Fatherland Front of commune, ward, or special zone affiliated to the provincial Committee (hereinafter referred to as the commune-level Committee). At each level, there is a Standing Committee of the Committee of Vietnam Fatherland Front.

The organization, tasks, and powers of the agencies of the Vietnam Fatherland Front are prescribed by the Charter of the Vietnam Fatherland Front.

5. The phrase “propose” is replaced with “agree with” in Clause 1 of Article 25 and Clause 1 of Article 32; the phrase “At the request of” is replaced with “After agreeing with” in Clause 3 of Article 26 and Clause 3 of Article 33.

6. The phrase “at the provincial level” is added after “People’s Council” in Clause 2 of Article 20; the phrase “in accordance with” is added before “the regulations of the law” in Clause 3 of Article 26 and Clause 3 of Article 33.

7. The phrase “district-level,” in Clause 2 of Article 16; the phrase “from district level and above” in Clause 2 of Article 18; the phrase “, district level” in Clause 2 of Article 20 are removed.

Article 2. Amendments to the Law on Trade union

1. Amendment to Article 1:

“Article 1. Vietnam Trade Union

The Vietnam Trade Union is a great socio-political organization of the working class and employees. The Vietnam Trade Union is founded on a voluntary basis and is a part of the political system placed under the leadership of the Communist Party of Vietnam and affiliated to the Vietnam Fatherland Front. Vietnam Trade Union represents, cares for, and protects the legitimate and rightful rights and interests of trade union members and employees; Vietnam Trade Union is the sole representative of workers at the national level in labor relations and international trade union relations and participates in state management and socio-economic management. The Vietnam Trade Union joins in the inspection and supervision of operations of state agencies, organizations, units, and enterprises on issues related to the rights and obligations of employees. The Vietnam Trade Union encourages employees to study, improve knowledge and professional skills, observe the law, and build and defend the Fatherland.

2. Amendment to clauses 2 and 3 of Article 4:

“2, Grassroots trade union means a grassroots organization of the Vietnam Trade Union, including trade union members in one or multiple organizations, units, or enterprises. They are recognized by the trade unions superior to grassroots trade unions in accordance with the law and charter of the Vietnam Trade Union.

3. Grassroots occupational organizations mean grassroots organizations of the Vietnam Trade Union, including employees without labor relations in the same industry or other specific employees. They are recognized by the trade unions superior to grassroots trade unions in accordance with the law and charter of the Vietnam Trade Union.

3. Amendment to clause 1 of Article 8:

“Article 8. Organizational system of Vietnam Trade Union

1. Vietnam Trade Union is a unified organization consisting of the following levels:

a) Central level: Vietnam General Confederation of Labor;

b) Trade unions superior to grassroots trade unions: labor federations of provinces and cities (hereinafter referred to as provincial labor federations); central industrial trade unions; trade unions of business groups; trade unions of corporations of the Vietnam General Confederation of Labor; and special trade unions superior to grassroots trade unions established with permission from competent authorities in conformity with the Trade Union organization;

c) Grassroots trade unions: grassroots trade unions, grassroots occupational organizations.”.

4. Amendments to clauses 2 and 3 of Article 14:

“2. The chairperson of the provincial labor federations shall be invited to attend meetings and conventions of the People’s Council, Standing Committee of the People’s Council, the People’s Committee at the same level, and relevant agencies and organizations when discussing issues related to the rights and obligations of trade union members, employees, trade union organizations, and socio-economic development in the area.

3. The chairperson of central industrial trade unions. trade unions of business groups, trade unions of corporations; trade unions superior to grassroots trade unions shall be invited to attend meetings and conventions of specialized agencies, relevant agencies, and organizations when discussing issues related to the rights and obligations of trade union members, employees, and trade union organizations.”.

5. Amendment to clause 2 of Article 19:

“2. Trade unions superior to grassroots trade unions have the right and responsibilities to send trade union cadres to enterprises, cooperatives, cooperative unions, organizations, and units to encourage, and guide employees to join and establish grassroots trade unions.”.

6. Addition of clauses 7 after 6 of Article 31:

“7. The Vietnam General Confederation of Labor shall send annual report to the Standing Committee of the Central Committee of the Vietnam Fatherland Front on the budget estimates and final statements of the trade union finances of the Vietnam General Confederation of Labor as prescribed in points a, b, and d of Clause 1 of Article 29 and Clause 2 of Article 31 hereof.”.

7. Amendment to point a of clause 2 of Article 32:

a) The management, use, and operation of assets of trade union at the Vietnam General Confederation of Labor, trade unions superior to grassroots trade unions, and trade unions’ affiliated public service units shall comply with the provisions of the law on the management and use of public property and other relevant law.

8. The phrase “agencies, organizations, units, enterprises, cooperatives, cooperative unions”  is replaced with the phrase “enterprises, public service units not receiving 100% salary from the state budget, cooperatives, cooperative unions and other employers according to the law” at Point b of Clause 1 of Article 29; the phrase “according to the provisions of the law on state budget” is added after the phrase “Support from the State budget” at Point c of Clause 1 of Article 29; the phrase “; public service unit not receiving 100% salary from the state budget as prescribed in Point b of Clause 1 of this Article” is added after the phrase “case of failing to pay or late-payment of trade union contributions” at Clause 2 of Article 29.

9. Clause 4 of Article 4 and Clause 3 of Article 19 are annulled.

Article 3. Amendments to the Youth Law

1. Amendment to clause 3 of Article 17:

“3. Enable the youth to take out concessional loans to create their own jobs and advance their business operation.”.

2. Amendment to clause 1 of Article 28:

“1. Ho Chi Minh Communist Youth Union is a socio-political organization of Vietnamese youth affiliated to Vietnam Fatherland Front that acts as the core of youth movements and youth organizations; provides guidelines for activities of early adolescents and pre-adolescents and takes charge of the Ho Chi Minh Young Pioneer Organization.”.

Article 4. Amendments to the Law on Implementation of Grassroots-level Democracy

1. Amendment to Article 62:

“Article 62. Operation of People’s Inspectorates

1. Based on the resolutions made in staff meetings of the agency or unit, the People’s Inspectorate shall develop a working program for each quarter, every 6 months, and each year and organize the implementation.

2. The People’s Inspectorate shall report its performance in the staff meeting of the agency or unit.”.

2. Amendment to point a of clause 2 of Article 83:

a) Assist the Government in the state management of implementation of democracy in communes, wards and special zones, state authorities, public service providers and employing entities;”.

3. The phrase “commune-level towns” is replaced with the phrase “special zones” in Clause 1 of Article 2; Clause 1 of Article 4; the title of Chapter II; the title of Section 1 and the title of Subsection 2 of Section 4, Chapter II; Clauses 3, 4, and 14 of Article 11; point k of Clause 1 of Article 12; Clauses 7 and 9 of Article 25; Clause 2 of Article 26; the title of Article 29; Clause 2 of Article 31; Clause 3 of Article 34; point c of Clause 2 of Article 35; the title of Article 36; Clauses 1 and 3 of Article 36; the title of Article 37; the title of Article 38; the title and Clause 1 of Article 39; the title and Clause 3 of Article 40; Clause 1 of Article 41; point c of Clause 2 of Article 86.

4. The phrase ” Cooperate with the Executive Committees of the Trade Unions of workplaces, based on” is replaced with the phrase “Based on” at point a of Clause 1 of Article 59; the phrase “Trade Unions and other internal organizations” is replaced with the phrase ” internal organizations ” at Clause 5 of Article 54 and point c of Clause 1 of Article 59.

5. The phrase ” in communes” in Clause 3 of Article 8; Clauses 4 and 10 of Article 11; Clause 3 of Article 24; Clause 2 of Article 30; points b and c of Clause 1 of Article 31; Clause 2 of Article 37; and Clause 1 of Article 38 is removed.

6. The phrase “of districts” in clause 2 of Article 25 and “and the commune-level People’s Committees” in Article 85 are removed.

7. The phrase “, Executive Boards of Trade Unions of workplaces” at point e of Clause 1 of Article 47; the phrase “Executive Boards of Trade Unions of workplaces,” at Clause 1 of Article 50; the phrase “after agreeing with the Executive Boards of Trade Unions of workplaces” at Clause 2 of Article 50; remove the phrases “cooperate with the Trade Unions of workplaces” and “after consulting the Trade Unions of workplaces” at Clause 1 of Article 51; the phrase “agree with the Trade Unions of workplaces” at point b of Clause 2 of Article 51; the phrase “and representatives of the Executive Committees of the Trade Unions of affiliates ” at point d of Clause 2 of Article 51; the phrase “, Chairman of the Trade Unions of workplaces” at point d of Clause 4 of Article 51; the phrase “cooperate with the Executive Boards of Trade Unions of workplaces in reaching agreement on the policy,” at Clause 1 of Article 52; the phrase “cooperate with the Executive Boards of Trade Unions of workplaces” at Clause 2 of Article 52; the phrase “cooperate with the Executive Boards of Trade Unions of workplaces” at Clause 3 of Article 52; the phrase ” Executive Committee of the superior Trade Union,” at Clause 4 of Article 52; the phrase ” at the request of the Executive Boards of Trade Unions of workplaces” at Clause 1 of Article 60; the phrase “proposed by the Executive Boards of Trade Unions of workplaces” at Clause 3 of Article 60 are removed.

8. Point b and point h of Clause 4 of Article 51; Clause 2 of Article 55; Clause 2 of Article 63; Clause 3 of Article 83; Clauses 3 and 4 of Article 86.

Article 5. Implementation clauses

1. The Law comes into force on July 01, 2025.

2. Trade unions and Executive Committees of Trade Unions at public service units not receiving 100% of their salaries from the state budget shall continue to implement the regulations of Chapter III of the Law on Implementation of Grassroots-level Democracy No. 10/2022/QH15.
