Circular No. 08/2026/TT-BCT on amendments to Circular No. 04/2020/TT-BCT on the auction of import tariff-rate quotas for used automobiles under Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP)

CIRCULAR

On amendments to certain articles of Circular No. 04/2020/TT-BCT dated January 22, 2020 of the Minister of Industry and Trade on the auction of import tariff-rate quotas for used automobiles under Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP)

Pursuant to Law on promulgation of legislative documents No. 64/2025/QH15 amended or supplemented by Law No. 87/2025/QH15;

Pursuant to Law on Foreign Trade Management No. 5/2017/QH14;

Pursuant to Decree No. 40/2025/ND-CP of the Government on functions, tasks, powers and organizational structure of the Ministry of Industry and Trade amended by Decree No. 109/2025/ND-CP and Decree No. 193/2025/ND-CP;

At the request of the Director of the Agency of Foreign Trade;

The Minister of Industry and Trade hereby promulgates a Circular on amendments to certain articles of Circular No. 04/2020/TT-BCT dated January 22, 2020 of the Minister of Industry and Trade on the auction of import tariff-rate quotas for used automobiles under Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP)

Article 1. Amendments to clause 2 Article 5 of Circular No. 04/2020/TT-BCT dated January 22, 2020 of the Minister of Industry and Trade:

“2. Used automobiles imported under the tariff rate quota prescribed in Article 3 of this Circular must comply with the rules of origin under the CPTPP and must be accompanied by a certificate of origin upon carrying out import procedures.”

Article 2. Amendments to clause 1 Article 6 of Circular No. 04/2020/TT-BCT dated January 22, 2020 of the Minister of Industry and Trade:

“1. The principles and procedures for auctioning tariff rate quotas shall be implemented in accordance with property auction laws.”

Article 3. Amendments to Appendix I enclosed with Circular No. 04/2020/TT-BCT dated January 22, 2020 of the Minister of Industry and Trade:

1. The phrase “Engine power ≤ 3.000 cm³ (units)” is replaced with the phrase “Engine displacement ≤ 3.000 cm³ (units)” in the third column of Appendix I.

2. The phrase “Engine power ≥ 3.000 cm³ (units)” is replaced with the phrase “Engine displacement > 3.000 cm³ (units)” in the fourth column of Appendix I.

Article 4. Implementation clauses

1. This Circular comes into force from February 25, 2026.

2. Decision No. 731/QD-BCT shall be annulled./.
