Conditions and procedures for granting study abroad consultancy licenses 2026

1. What is study abroad consultancy service business?

According to the provisions of Clause 2, Article 115 of Decree 125/2024/NĐ-CP, study abroad consultancy service business includes:

– Introducing and consulting on educational policies of countries and territories; advising on the selection of schools, courses, majors, and levels suitable for the learners’ abilities and aspirations;

– Organizing advertisements, conferences, seminars, fairs, and exhibitions on studying abroad in accordance with the law;

– Organizing student recruitment and enrollment for study abroad;

– Organizing training for necessary skills for Vietnamese citizens going abroad to study;

– Organizing for Vietnamese citizens to go abroad for study, and for parents or guardians to visit training locations abroad in accordance with the law;

– Other activities related to study abroad consultancy service business.

2. Conditions for study abroad consultancy service business

Conditions for study abroad consultancy service business are specified in Article 116 of Decree 125/2024/NĐ-CP on conditions for investment and operation in the field of education, specifically:

2.1. Conditions for business form

Organizations business in study abroad consultancy services include:

– Enterprises and branches of enterprises established and operating in accordance with the Law on Enterprises;

– Public service units with the function of providing study abroad consultancy services;

– Foreign educational organizations operating legally in Vietnam.

2.2. Personnel conditions

Having a team of staff directly providing study abroad consultancy that meets the following requirements:

– Possessing a university degree or higher; having the ability to use at least one foreign language at level 4 or higher according to the 6-level Foreign Language Proficiency Framework for Vietnam and its equivalents;

– Having a certificate of professional training in study abroad consultancy as prescribed.

2.3 Facilities conditions

Having a stable operating headquarter, facilities, and equipment to organize study abroad consultancy activities; introductory materials and consultancy information on educational policies of countries and territories; consultancy materials on schools, courses, majors, and training levels.

3. Procedures for granting the certificate of registration for study abroad consultancy service business

3.1. Application components

– An application for the certificate of registration for study abroad consultancy service business (according to Form No. 07, Appendix IV) attached to Decree 125/2024/NĐ-CP;

– A copy of the business registration certificate, establishment decision, or investment registration certificate;

– A copy of legal documents proving land use rights, house ownership rights, or a location lease agreement of the study abroad consultancy service organization.

3.2. Implementation process

The organization sends 01 set of documents prescribed in Clause 2 of this Article through the online public service portal, by post, or directly to the Department of Education and Training where the study abroad consultancy service business is deployed;

Within 15 days from the date of receipt of a complete and valid application, the Department of Education and Training organizes an appraisal and prepares an appraisal report to evaluate the fulfillment of regulations on conditions for study abroad consultancy service business;

Within 05 working days from the date of the appraisal report, if the conditions are met, the Director of the Department of Education and Training shall grant the certificate of registration for study abroad consultancy service business; if the conditions are not met, a written notice shall be sent to the organization requesting the certificate, clearly stating the reasons.

The certificate of registration for study abroad consultancy service business has a term of no more than 05 years, can be extended, and each extension shall not exceed 05 years. The extension of the certificate must be carried out within 06 months before the expiration date.
